LANDLORD RESPONSIBILITY: Landlord agrees to inspect the Property prior to renting the Property for pests and to pre-treat the home in the event that any pests are detected.
RESIDENT RESPONSIBILITY:
Upon move-in, Resident shall conduct a thorough inspection of the Property for pests. If Resident fails to report ANY pest infestation and/or problems with the Property within ten (10) days, it shall be an acknowledgement by Resident that the Property is in an acceptable and pest-free condition.
Resident agrees to keep the home in a clean and debris free condition. This includes but is not limited to: placing all food in properly sealed containers and cleaning the home and all food preparation areas on a daily basis.
Resident agrees that they will not knowingly or negligently bring any items into the Property that may be infested with pests or create any condition that would cause pest issues.
Resident agrees to pay for any pest treatments following the 10 day move in window.
In the event that pests are detected in the Property:
Resident agrees to notify the landlord in a timely and reasonable manner.
Landlord will discuss pest control options with Resident to determine preferred solution (i.e. hire pest control company, purchase pest control materials).
Resident will be directly responsible for all charges (labor and materials) associated with the pest control procedure(s).
Resident further agrees to comply with all recommendations and requests from management and pest control specialists
BEDBUGS:
Resident should perform routine inspections to help prevent infestations. Guidelines are provided by the EPA: https://www.epa.gov/bedbugs.
If bedbugs are discovered in the Property or in a surrounding Property, the Resident agrees to comply with additional steps including, but not limited to, any protocol provided by the pest control company and the latest directive from the EPA: https://www.epa.gov/bedbugs.
Other:
Landlord shall not be liable to Resident for any damage caused by pests, including, but not limited to, replacement of furniture, medications or medical expenses.
Landlord shall not be liable to Resident for any damage caused to Resident’s personal property during pest control treatments or inspections.
Landlord and its agents shall not be liable to Resident or their guests for any harm as a result of any pest.
